Terms and conditions
I. DEFINITIONS
Art. 1. This document contains the terms and conditions of use of the services offered by SC SD PROINVEST SRL-D. through http://www.sd-modelcar.ro.
II. INTRODUCTION
Art. 2.1 This document defines the framework within which sd-modelcar.ro agrees to provide products to its customers and users. This document represents an agreement between sd-modelcar.ro and its customers. Placing an order on the website www.sd-modelcar.ro represents your agreement to the terms and conditions below.
Art. 2.2. sd-modelcar.ro reserves the right to modify this document without prior notice. The most recent version of the Terms and Conditions can be read at any time using the "Terms and Conditions" link.
Art. 2.3 The products contain very small parts and are not recommended for children under 14 years of age.
III. ORDER, PAYMENTS AND DELIVERY
Art. 3. Any order will be made online on the website http://www.sd-modelcar.ro. Customers are obliged to enter complete, correct and true data in the form.
Art. 3.1. Order the products by clicking on the "Add to cart" button, then click "Complete order" to proceed to filling out the online forms. Choose the delivery method, click "Continue", re-read the information sent, then click the "Confirm order" button once.
Art. 3.2. The order will be processed, the existence of the products in stock will be checked, after which you will be contacted (by email or phone) by a representative of our company who will confirm or not the order placed online. He will also ask you to fill in the billing or delivery data (if they are incomplete). If the products are in stock and all the data is complete, the goods will be shipped by express courier with payment upon receipt of the package or after payment on account. If you have requested personal collection of the ordered products, we will reserve the ordered products for a maximum of 3 days, if the payment has not already been made.
Art. 3.3. Payment will be made on a cash on delivery basis when the package is delivered to you, by payment order before the products are shipped or by cash/check if the delivery is made in person.
Art 3.4. For orders containing products in the supplier's stock, sd-modelcar.ro may charge an advance payment for the product or a payment of at least 50% of the value. Products ordered from the supplier's stock cannot be returned.
IV. RETURNING PRODUCTS
Art. 4.1 The customer has the right, within 14 days of receiving the ordered products, to notify in writing (otherwise we will not accept the receipt of the returned product) the company SC SD PROINVEST SRL-D of his decision to give up the ordered products. The company SC SD PROINVEST SRL-D. has the obligation to return the value of the ordered products within 14 working days of receiving them.
Art. 4.2. Returned products must be in the same condition as upon receipt: without defects (except for hidden defects), in the original package in which they were delivered and accompanied by a copy of the invoice and proof of payment. Returned products will be evaluated upon receipt and if there are defects, the value of the products will be returned, from which the value of repairs will be deducted to bring the product to its original condition!
Art. 4.3 If the packages have suffered damage, the complaint regarding the condition of the products must be made to the CARRIER.
Art. 4.4 If the product was received with defects, it is necessary that its return be made including proof of receipt of the package without damage (photos, carrier declaration, etc.)
Art. 4.5 The cost of return shipping will be borne by the beneficiary of the product.
Art. 4.6 IMPERFECTIONS! The models/products sold by our company are largely (70% of the product value is labor) handmade and there may be small imperfections, being considered products in the HAND-MADE category. Therefore, in cases where small manufacturing imperfections are found, the exchange of products will be made only after a careful evaluation of them and only with the personal acceptance of the buyer. The exchange of products with small manufacturing imperfections by courier is NOT accepted. The company's staff does not deal with the detailed analysis nor with the taking of images of the products to be sold and/or exchanged.
Art. 4.7 The return/exchange of products will only be made accompanied by the purchase invoice and only within a maximum period of 14 days from its receipt by the buyer.
Art 4.8 Products brought to order, from the supplier's stock, are not subject to return.
V. PRODUCT WARRANTY
Art. 5. The warranty for model cars is one year, only for the electronic part . The warranty covers any defect found following normal use of the products, without traces of shock, impact, writing, scratches or traces of water inside the electronic products.
VI. CONFIDENTIALITY. PROCESSING OF PERSONAL DATA
Art. 6.1. According to the requirements of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, SC SD PROINVEST SRL is obliged to manage in a safe manner and only for the specified purposes, the personal data that you provide us about yourself, a member of your family or another person. The purpose of collecting the data is invoicing, resolving customer requests, questions or complaints, allocating or offering discounts or additional services.
You are required to provide all the data requested upon registration, as this is necessary for contacting you and fulfilling orders.
Art. 6.2. The recorded information is intended for use by SC SD PROINVEST SRL and may be communicated to third parties only with your consent.
According to Law no. 677/2001, you have the right to access, to intervene in your data, the right not to be subject to an individual decision and the right to address the courts. At the same time, you have the right to oppose the processing of personal data concerning you and to request the deletion of your data. To exercise these rights, you can send a written, dated and signed request to the address of SC SD PROINVEST SRL, Bucharest City, sect. 4, str. Tohani, no. 1, bl. 29, sc. D, et. 8, ap. 168. You are also entitled to address the courts. If some of the data about you is incorrect, please inform us as soon as possible.
Art. 6.3. By completing the newsletter form on the website http://sd-modelcar.ro, the user grants his/her consent to receive commercial emails about site updates or news appearing on sd-modelcar.ro. The user can unsubscribe using the same form.
VII. ACCOUNT, PASSWORD AND DATA SECURITY
Art. 7. The client is responsible for maintaining the security of the username, passwords and other sensitive information. If there is any doubt in this regard, the client must modify or request the modification of the authentication data by contacting the support team.
VIII. LIMITED LIABILITY
Art. 8. SC SD PROINVEST SRL assumes no responsibility and cannot be held liable for any damages arising from the use of information or products purchased through sd-modelcar.ro. Users expressly agree that the use of this site and the purchase of products is at their own risk.
Art. 8.1. SC SD PROINVEST SRL-D permanently updates the security of the site and its means of communication for sd-modelcar.ro , but does not guarantee that they cannot contain viruses or other harmful components.
Art. 8.3. Part of the content of the site, namely the texts, product descriptions, their technical characteristics, their images and symbols, is made available to us by manufacturers and suppliers. For this reason, sd-modelcar.ro does not assume responsibility for damages caused by errors, inaccuracies or non-update of information published or maintained on the site. In addition, the images presented on the site serve as examples, and the products actually delivered may differ from the images in any way (color, accessories, appearance, etc.)
Art. 8.4. sd-modelcar.ro does not guarantee the availability of all products displayed in stock. Orders placed on the site may include products that are currently out of stock. Final confirmation of the order is made only after a representative of our company has contacted the person who placed the order. If the buyer cannot be contacted, the order is canceled.
IX. DISPUTES
Art. 9. Any dispute arising between the client and SC SD PROINVEST SRL-D shall be resolved amicably, by agreement between the two parties. If this is not possible, the Romanian courts shall have jurisdiction.
X. FINAL PROVISIONS
If any of the above clauses is found null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses. With the purchase and placing the order, the customer accepts without objection the conditions and terms of use, their value being the same as a validly concluded contract.
